Terms and conditions of the Good Time Day Spa online store

I. Definitions
§ 1
In these Terms and Conditions, hereinafter referred to as the

“Terms and Conditions
“, the following terms shall be understood:

1. Service Provider” – a limited liability company operated under the name GT52 Sp. z o.o. Address: ul. Grunwaldzka 52, 60-311 Poznań NIP: 779-255-98-89, hereinafter referred to as the Administrator.
2. “Website” or “Shop” – a website available at https://goodtimemedicalspa.pl/ and its subpages,
   
3. “User” – an entity that is a natural or legal person who has purchased goods from the Store, as well as an entity visiting the Website in order to conclude one of the above agreements,
   
4. Consumer Entrepreneur” – a User who is a natural person for whom the concluded Agreement is not of a professional nature, which is confirmed by the subject of his business activity disclosed in the Central Registration and Information on Economic Activity.

II. General
§ 2
The Terms and Conditions define the rules for the provision of electronic services by the Service Provider to Users, consisting in the possibility of purchasing goods from the Service Provider’s assortment.
§ 3
The content presented on the Website, in particular announcements, advertisements, price lists and other information, constitute only an invitation to submit offers.
§ 4
The Service Provider may modify the content of the Website, prices and assortment, as well as carry out and cancel promotional campaigns.

III. Technical conditions necessary for the use of services
§ 5

1. In order to use the Website, it is not necessary for the User’s computer or other device to meet any special technical conditions. It is required to have access to the Internet, an e-mail address, and a standard operating system and a web browser. When using the Website, as well as during communication with the Service Provider, the User does not incur any other costs for the use of the means of distance communication other than those usually used.
2. In order to properly use the Website, as well as to place an order leading to the conclusion of the Agreement, it is required to enable cookies in the web browser. Cookies are used to maintain the User’s session after logging in to the Website and to maintain the process of placing an order by the User. It is then possible to delete them through the appropriate options available in your web browser or with the help of other software. Detailed information on cookies can be found in the Privacy Policy.
   

IV. Price
§ 6

1. Sales made in the Store are subject to a fee.
   

2. The price disclosed on the relevant subpage of the Website is expressed in Polish zlotys and in the gross amount.
3. Prices do not include delivery costs, which are specified separately according to the rules set out in the delivery document available at https://goodtimemedicalspa.pl/regulaminy/zasady-dostaw/. Shipping costs are added to each order, which are covered by the customer. The cost of shipping products depends on the selected payment method, the value of the entire order and the delivery method and is given in the order summary displayed on the Store’s subpages when the Customer places the order (before concluding the sales contract).
4. The price is payable immediately after the conclusion of the Agreement.
5. Payment can be made:
   1. By credit card
   2. Transfer
   3. in the form of PayU\Przelewy24 online payment,

depending on the payment method you choose.

6. The User agrees to the Service Provider’s use of electronic invoices sent to the e-mail address indicated when placing the order.

V. Order
§ 7

1. Placing an order is possible only in Polish.
2. The Order does not require the creation of an Account by the User.
3. The order consists in selecting the appropriate product, adding it to the cart, providing the buyer’s and shipping details, choosing the delivery method in the form of forms placed on the Website subpage and paying for the order.
4. Orders can be placed 7 days a week, 24 hours a day.
5. In the forms available on the Website, it is forbidden to provide unlawful content, and in particular to provide personal data of third parties without appropriate authorization.
   
6. The Order Form constitutes the Service Provider’s offer addressed to the User regarding the conclusion of the Agreement.
7. It is not allowed to provide fictitious data or data of persons other than the User in the form. Incorrect completion of the order form will result in incorrect documentation of the transaction.
8. The form must be filled in by filling in all the fields marked as required. In the order form, the User also selects the form of payment.
9. Placing an order requires a statement:

• to read and accept the Terms and Conditions and the Policy,
• in the case of choosing the form of online payment – additionally a statement of acceptance of the terms and conditions of making payments in PayU\Przelewy24,
• in the case of placing an order by a natural person – a statement as to whether the Agreement is of a professional nature,

After filling in the order form, click the “Buy and pay” button, which will send the form to the Service Provider and redirect you to the appropriate subpage of the Website, depending on the selected form of payment. This action is tantamount to the User’s acceptance of the Service Provider’s offer to conclude the Agreement. At this moment, the Agreement between the User and the Service Provider is concluded.
11. If the case of selecting to pay by traditional bank transfer, one will receive an e-mail containing the data necessary to make the transfer. In the case of selecting to pay online, one will be redirected to the PayU\Przelewy24 website to make a payment through it.
12. Immediately after the Service Provider receives the order form, an e-mail confirming the conclusion of the agreement and containing these Terms and Conditions will be sent to the address provided by the User.

VII. Intellectual property
§ 8

1. All works, descriptions of services, trademarks and other materials contained on the Website are the intellectual property of the Service Provider or authorized third parties. Their use without the consent of the Service Provider or authorized third parties will constitute copyright infringement.
2. All rights to the works, trademarks and other materials constituting the Documentation are vested in the Service Provider or authorized third parties.

Delivery

§ 9

1. 1. The order is delivered, depending on the customer’s choice:
      1. In person to the Salon
      2. through specialized postal operators or courier companies on the terms specified in detail at the

   2. The Store will inform the Customer about the shipment of the products by e-mail.

VIII. Complaint procedure
§ 8

1. Any complaints should be submitted to the Service Provider.
2. The complaint should include the User’s data enabling the User to send him a response to the complaint and a description of the event on which it is based.
3. The Service Provider shall consider the complaint and inform the User of the outcome of its consideration within 14 days from the date of its receipt.
4. The deadline for considering a complaint is deemed to have been met if the Service Provider sends a response to the complaint before its expiry.

IX. Duration of contracts
§ 10

The User has the right to withdraw from the agreement within 14 days from the date of conclusion of the agreement. Withdrawal is effected by submitting a statement of withdrawal from the agreement by electronic means by sending it to the following e-mail address: recepcja@goodtimemedicalspa.pl or by sending it to the address of the Service Provider’s registered office. The statement may also be submitted using the withdrawal form available on the website at

The Service Provider shall immediately inform the Service Recipient of the receipt of the statement by sending an e-mail to the address indicated by the Service Recipient on the Website.

X. Amendments to the Terms and Conditions
§ 11

1. The Service Provider has the right to amend the Terms and Conditions on the terms set out in the provisions of this paragraph, in particular in the event of one of the following reasons:
   1. changes in the applicable provisions of law that affect the content of the Documentation or the legal relationship between the Service Provider and the User,
   2. modification of the legal relationship between the Service Provider and the payment operator for the service – PayU\Przelewy24, affecting the terms and conditions of the provision of services by the Service Provider.
2. Information about the amendment to the Terms and Conditions will be posted on the Website, and furthermore, the Service Provider will send to the Users, to the e-mail addresses provided by them on the Website, information about the planned amendment to the Terms and Conditions, together with the content of the new Terms and Conditions and an indication of the changes to be introduced. The information will be sent to the Users at least 14 days before the date of entry into force of the planned changes.
3. In the event of a change in the Terms and Conditions, its current version will always be available on the Website: www.goodtimemedicalspa.pl The User’s use of the service after the introduction of changes to the Terms and Conditions will be tantamount to acceptance of the new wording of the Terms and Conditions.
4. If the User does not accept the planned changes, the User may terminate the Agreement or the Account Management Agreement. In such a situation, the User shall be bound by the wording of the Terms and Conditions in its original version until the termination of the Agreement or the Account Management Agreement.

XI. Final provisions
§ 12

1. The current content of the Terms and Conditions is available at

   and at the Service Provider’s headquarters.
2. In matters not covered by the Terms and Conditions, the provisions of Polish law shall apply.
