Terms and conditions for the purchase and redemption of gift vouchers in the online store

  1. Definitions:
    1. Buyer – a person purchasing a Voucher,
    2. Recipient – the holder of the Voucher indicated by the Buyer during the process of placing an order for the Voucher; a person with full legal capacity,
    3. Service Provider – GT52 Sp. z o.o. with its registered office in Poznań (60-311) at ul. Grunwaldzka 52, NIP: 779-255-98-89,
    4. Gift Voucher – a term bearer document for a specific treatment (Voucher) and/or a package of treatments (gift card) for a specified amount purchased by the Buyer for the Recipient,
    5. Gift Voucher Terms and Conditions – these Terms and Conditions for the purchase and redemption of Gift Vouchers,
    6. Terms and Conditions of Use of Services – Terms and Conditions of Use of Services at Good Time Institute&Medical Spa of 1.04.2019
  2. GENERAL
    1. The Gift Voucher has its own individual identification number.
    2. Gift Cards can be purchased through the https://goodtimemedicalspa.pl/sklep-online website.
    3. Gift vouchers entitle you to use the services in accordance with the price list in force at the Service Provider on the day the service is provided.
    4. By placing an order for a Gift Voucher, the Buyer makes an offer to the Service Provider to conclude a contract for the sale of the Gift Voucher on the terms and conditions indicated by the Buyer in the order. The Agreement is concluded by accepting the offer by the Service Provider, at the time of receipt by the Buyer of confirmation of the terms and conditions of the Gift Voucher sale agreement by the Service Provider, sent in an electronic message to the e-mail address provided by the Buyer during the purchase process.
  3. TERMS AND CONDITIONS FOR REDEEMING A GIFT VOUCHER
    1. The Gift Voucher entitles the Recipient to make a payment for a specific treatment (Voucher) or for any treatment of their choice (gift card) or preparation from the Service Provider’s offer at the regular price, not including discounts (unless otherwise stated)
    2. The Recipient is obliged to book a convenient date of the visit in advance (at least one week before the planned visit) by providing the Voucher/Gift Card number (located on the Gift Voucher) at the Salon’s telephone number or in person at the Salon.
    3. The gift voucher must be presented before the treatment.
    4. The expiry date can be found on the Gift Voucher.
    5. The gift voucher is valid for 3 or 6 months from the date of purchase. The Gift Voucher must be redeemed during this period. After the expiry of the validity period of the Voucher, in whole or in part, the unused value is lost.
    6. A gift voucher can only be used by the Recipient.
    7. If the reservation is not cancelled by phone or in person, 24 hours before the scheduled visit, the gift voucher will be deemed to have been redeemed.
    8. In the event that the value of the service is lower than the value of the Gift Voucher, the Service Provider is not obliged to refund the difference in value.
    9. In the event that the value of the service exceeds the value of the Gift Voucher, the Recipient pays the difference.
    10. If the Gift Voucher includes treatments that cannot be performed at the Recipient’s due to contraindications, it is possible to replace them with others of the same or similar value.
    11. Gift vouchers cannot be combined with promotions and discounts available from the Service Provider.
    12. After prior consultation, the Gift Voucher can be redeemed during several visits to the Service Provider.
    13. A Gift Voucher can only be redeemed from the Service Provider from which it was purchased.
    14. A gift voucher can only be used to pay for services during its validity period.
    15. A gift voucher purchased in a promotion cannot be used to pay for goods or cosmetics available from the Service Provider in the Salon.
    16. A gift voucher purchased in a promotion cannot be used for aesthetic medicine treatments or permanent make-up services.
    17. A gift voucher purchased in a promotion cannot be used for injectable treatments (Mesotherm, Vital Injector, Tissue Stimulators, Demapen).
    18. The packaging of the Gift Voucher and the extras (freebies) contained therein depend on the value of the Voucher.
    19. The Gift Voucher Terms and Conditions are an integral part of the Gift Voucher sales agreement.
    20. The condition for the provision of the service by the Service Provider is the acceptance of these Terms and Conditions by the Buyer.
  4. WITHDRAWAL FROM THE CONTRACT
    1. Vouchers are non-refundable and cannot be exchanged for cash.
    2. The Ordering Party may withdraw from the purchase agreement of the Gift Voucher without giving a reason by submitting an appropriate statement in writing or in electronic form to the following e-mail address: recepcja@goodtimemedicalspa.pl within 14 (fourteen) days from the date of conclusion of the contract for the sale of the Gift Voucher.
    3. The buyer loses the right to withdraw from the contract in accordance with point 2. above, at the time of using the Gift Voucher (making a payment with it in accordance with Section II, Section 1).
    4. In order to meet the deadline mentioned in point 2 above, it is sufficient to send a statement before its expiry.
    5. In the event of withdrawal from the agreement, the Service Provider shall return to the Buyer all payments received, immediately but no later than 14 (fourteen) days from the date on which the Service Provider was informed of the decision to exercise the right to withdraw from the agreement.
    6. In the event of effective withdrawal from a contract concluded at a distance, the contract will be considered not concluded.
    7. The Service Provider shall refund the payment using the same payment methods as the Buyer chose when placing the order, unless the Buyer has chosen another method of return, which will not entail additional costs for the Service Provider.
    8. The Buyer does not have the right to withdraw from the agreement in relation to the agreements referred to in Art. Article 38 of the Law of 30 May 2014. on consumer rights, in particular contracts: declaration of services, if the entrepreneur has fully performed the service with the express consent of the Consumer, who has been informed before the commencement of the service that after the performance of the service by the entrepreneur he will lose the right to withdraw from the contract in which the subject of the service is a non-prefabricated item, manufactured according to the Consumer’s specification or serving to meet his individualized needs, in which the subject of the service is things, which, after delivery, due to their nature, are inseparably connected with other things, for the supply of digital content that is not recorded on a tangible medium, if the performance of the service began with the express consent of the Consumer before the expiry of the deadline for withdrawal from the contract and after the entrepreneur informed him of the loss of the right to withdraw from the contract.
  5. PROTECTION OF PERSONAL DATA
    1. As part of the performance of the contract by the Service Provider, personal data of natural persons are processed within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of individuals with regard to the
      processing of personal data and on the free movement of such data, and the enactment of Directive 95/46/EC (General Data Protection Regulation), the so-called “GDPR”.
    2. The administrator of personal data is – GT52 Sp. z o.o. with its registered office in Poznań (60-311) at ul. Grunwaldzka 52, NIP: 779-255-98-89,
    3. The Service Provider takes all necessary actions required by the provisions of the GDPR as well as by national regulations in order to ensure an appropriate level of protection of the processed personal data. In particular, it shall apply the security measures referred to in 32 et seq. GDPR.
    4. Detailed information on the principles of personal data processing is included in the Terms of Use and Privacy Policy.

    • The Buyer and the Donee may communicate with the Service Provider using the above-mentioned contact details.
    • The Buyer and the Donee may contact the Service Provider by phone from Monday to Friday from 9 a.m. to 9 p.m., and on Saturday from 9 a.m. to 5 p.m.
  7. FINAL PROVISIONS
    1. The contract for the sale of Gift Vouchers is concluded in Polish.
    2. The Service Provider reserves the right to amend the Gift Voucher Terms and Conditions for important reasons, in particular in the event of a change in the law, a change in payment and delivery methods, if these changes affect the implementation of the provisions of the Terms and Conditions. The Service Provider shall inform the Buyer of any change by e-mail at least 7 days in advance.
    3. To the extent not regulated by the Gift Voucher Terms and Conditions, the Terms and Conditions of Use of Services at Good Time Medical Spa of 1.04.2019 and the Privacy Policy of 1.04.2019 shall apply accordingly.     4. In matters not covered by the Terms and Conditions, the generally applicable provisions of Polish law shall apply, i.e. in particular: the Civil Code, the Consumer Rights Act, the Personal Data Protection Act, the GDPR.
    5. Any disputes arising between the Service Provider and the Buyer, who is not also a consumer, shall be resolved in the court competent for the registered office of the Service Provider.
